One final comment. To those of you who question my offering to pay for an escort that was given a false review by a troll who stalks her, just to clear her name. Under Quebec law, a contract in violation of "public order and good morals" is not enforceable in court. With the purchase of sexual services currently being in violation of the Criminal Code of Canada, a contract to supply money to purchase sexual services in exchange for a review would not be enforceable in the Quebec courts. This principle is as old as the civil law itself.

Didn't you read my post? I said the MERB court of law wouldn't enforce the defense of lack of legal consideration but a real court would. Did you miss that?

Ricky, had he not repaid the money, could have asserted a legal defense of failure of consideration due to the consideration (a promise to have sex with an escort and review her) being meretricious and illegal. Ricky's defense fails for the following reasons: (1) the MERB court of law does not recognize the legal validity of such a defense even if a real court of law would; and (2) Ricky, under the doctrine of estoppel, would be precluded from asserting such a defense because he agreed to engage in arguably illegal behavior; and (3) the consideration, if done in an outcall setting, would (arguably) not be meretricious or illegal at all, thus defeating the defense in the first place. However, Ricky's legal defenses, if any, are moot because he waived them by repaying the money owed under the contract.

As a matter of interest I am licensed in 3 jurisdictions in the USA, passed 3 bars (3 for 3, no fails, and law review in law school), and none of them, or any court in any of the 50 states for that matter, would have enforced this contract. But this is the MERB court of law and that post was tongue in cheek, which obviously you didn't get or didn't read. And the MERB court of law is not recognizing this defense. It has ruled. You don't like it, appeal to the MERB Court of Appeals.
